Hyperion Works terms of use.
These terms govern use of the Atlas platform at atlascore.app. Other Hyperion Works services are governed by their individual service agreements.

By accessing or using the Atlas platform (“Atlas,” “the Platform,” or “the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Platform.
These Terms constitute a legally binding agreement between you and Hyperion Works LLC (“Hyperion Works,” “we,” “us,” or “our”).
You must be at least 18 years of age to use Atlas. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3.1 Account Registration. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
3.2 One Person, One Account. Each account is registered to and for the exclusive use of a single individual. You may not share your login credentials with another person, allow another person to access the Platform using your account, or use another person’s account. Each person who uses the Platform must have their own account.
3.3 Accurate Information. You agree to provide accurate, current, and complete information when registering your account and to keep that information up to date.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:
Atlas is a multi-tenant platform. Users may belong to one or more organizations. Each organization is independently managed, and access to applications and data is scoped to that organization. Organization administrators are responsible for managing user access within their organization.
Access to certain applications and features within Atlas requires a paid subscription. Applicable pricing, billing cycles, and subscription terms are presented at the time of subscription and are incorporated into these Terms by reference.
If a payment fails, we will retry the charge and notify your organization’s billing contacts. If the balance remains unpaid seven days after the first failed charge, access to the affected applications is suspended until the balance is paid. Suspension does not delete your data.
All fees are non-refundable except as expressly provided in the applicable subscription terms or as required by applicable law.
Your use of the Platform is also subject to the Hyperion Works Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data collection and use practices.
You retain ownership of all content and data you submit to the Platform (“Your Data”). By submitting Your Data to Atlas, you grant Hyperion Works LLC a limited, non-exclusive license to store, process, and display Your Data solely as necessary to provide the Service to you.
Hyperion Works LLC may use aggregated, anonymized, and de-identified data derived from use of the Platform for analytical purposes, such as identifying usage trends and improving the Service. Such aggregated data will not identify you or your organization individually.
8.1 Connected Third-Party Accounts. Some Atlas applications let you connect a Google, Microsoft, or Apple account to import or synchronize your own files, contacts, or calendars. You choose whether to connect an account, and you can disconnect it at any time. Your use of those third-party services remains subject to their own terms. What Atlas accesses, and for how long, is described in the Privacy Policy.
Either party may terminate your account at any time. Upon termination of your account:
We are not responsible for any loss of data resulting from termination of your account.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HYPERION WORKS LLC DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYPERION WORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its then-current Commercial Arbitration Rules. The arbitration shall take place in Tempe, Maricopa County, Arizona. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.
BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.
We may update these Terms from time to time. When material changes are made, we will notify you through the Platform and by email prior to the changes taking effect. Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of those changes.
